📢 The sector study titled “Reflections of Digital Transformation on Competition Law,” conducted by the Turkish Competition Authority and involving contributions from 25 competition law enforcers, examines how the increase in internet usage and technological advancements affect the business models and working principles of the undertakings. The study is approximately 300 pages long and currently available only in Turkish.

According to the Authority, digital transformation reshapes consumer preferences in digital markets and complicates competition law enforcement.

Important notes from the study are as follows:

📍Digital markets have distinctive features compared to traditional business models and are of importance to competition authorities.

📍Characteristic features of digital markets pose challenges in defining relevant markets, determining enterprises’ market power, and designing appropriate legal instruments to address infringements.

📍Digital markets are characterized by strong network effects, data-driven power, evolving market structures, barriers to entry and growth in the market, rapid growth of undertakings, and their ability to shift operations across different sectors. All these factors affect competition law enforcement to a large extent.

📍The increasing number of internet users and time spent online in Turkey leads to consumers and users being more affected by the actions of undertakings operating in digital markets, which may limit or potentially limit competition.

📍In addition to the effects on consumers; investments, innovation and the competitive structure of digital markets also face the risk of being adversely affected by the anticompetitive behavior of technology firms.

📍The study addresses policy changes that are needed specifically for digital markets and aims to create a roadmap for the future for all stakeholders.

📍The study enables the Turkish Competition Authority to gain insight into its perspective on digital markets, existing legal tools for intervention in digital markets, and concrete applications.

📢 Rekabet Kurumunun yürüttüğü ve 25 rekabet meslek personelinin görev aldığı “Dijital Dönüşümün Rekabet Hukukuna Yansımaları” başlıklı ve yaklaşık 300 sayfalık çalışma, internet kullanımındaki artış ve teknolojik gelişmelerin, teşebbüslerin iş modelleri ve çalışma prensiplerini nasıl etkilediğini incelemektedir.
