Günay & Erdoğan has prepared this Privacy Notice in order to inform individuals about the processing of personal data by Günay & Erdoğan, the purposes and methods of such processing and the legal bases for data collection, the categories of recipient to whom personal data may be transferred, and individuals’ rights under the Law on the Protection of Personal Data No. 6698 (the “LPPD”). This Privacy Notice applies to individuals’ personal data and does not apply where Günay & Erdoğan acts as a “data processor”.
Günay & Erdoğan places transparency and accountability at the forefront of its data processing activities and processes personal data in accordance with the applicable legislation, solely within the purposes and limitations set out below, taking all necessary and appropriate technical and administrative measures.
Günay & Erdoğan’s relevant business and data processing operations are conducted in accordance with corporate policies and procedures that have been prepared in advance and in line with the applicable legislation. Günay & Erdoğan’s personal data processing operations are carried out as described in this Privacy Notice, in accordance with our policies and procedures on the processing, retention and destruction of personal data and with the applicable legislation.
Personal data is processed for the purposes set out in this Privacy Notice through information and documents produced or shared by individuals before, during or after any relationship with Günay & Erdoğan, or through other similar relationships; through transactions, stakeholders, and publicly available sources and platforms (such as media records, the trade registry and chambers of commerce); and through the communications, research, meetings, discussions and correspondence conducted by Günay & Erdoğan with individuals via oral, written and electronic channels, including our website and social media, by automated means (the electronic systems and programs we use) and by non-automated means (physical files and physical record-keeping activities).
Personal data will be stored in Türkiye for any applicable statutory retention periods and/or for as long as is necessary for the purposes of processing. At the end of the retention period required for the processing purposes, personal data will be deleted, destroyed or anonymised in accordance with the legislation and with Günay & Erdoğan’s relevant policies and procedures.
Processing of Personal Data in Our Core Activities
Personal data may be processed, to the extent necessary, for the purposes explained below in connection with the services provided to our clients and with Günay & Erdoğan’s administrative, management and financial activities, on the legal grounds that processing is necessary for the establishment or performance of a contract under Article 5(2)(c) of the LPPD, or that processing is necessary for the legitimate interests of Günay & Erdoğan under Article 5(2)(f) of the LPPD. Personal data may also be processed for the purpose of pursuing or defending legal proceedings, on the legal ground that processing is necessary for the establishment, exercise or protection of rights under Article 5(2)(e) of the LPPD, or for the purpose of fulfilling our legal obligations and complying with information and document requests from the competent authorities, on the legal ground that processing is necessary in order to fulfil our legal obligations under Article 5.
Your rights under the LPPD matter to us. You have the right to:
- be informed as to whether your personal data is being processed, and to request information as to whether your personal data is being processed;
- be informed as to the purposes of the processing and as to whether your personal data is being used in accordance with those purposes;
- know the third parties in Türkiye or abroad to whom your personal data is transferred;
- request the rectification of your personal data where it has been processed incompletely or inaccurately; to request the erasure or destruction of your personal data within the conditions set out in the LPPD; and to request that any such action be notified to the third parties to whom your personal data has been transferred;
- object to the processing of your personal data collected exclusively by automated means where this produces a result to your detriment;
- claim compensation where you suffer loss as a result of the unlawful processing of your personal data.

Please note that your request must relate to your own data. If you are acting on behalf of another person, you must provide us with a special power of attorney covering the request. Under the applicable regulations, your request must include your name, surname, Turkish identity number (or, for foreign nationals, your nationality and passport number), proof of identity, and the contact details to which our response should be sent.
We may update this Privacy Notice from time to time in order to reflect changes in the applicable laws and regulations or in our practices. We will notify you of any material changes to this Privacy Notice by publishing the updated version on our website, and we recommend that you check our website regularly to review the latest version of this Privacy Notice.
